1. Acceptance of Terms

By accessing or using MDS services, website, or mobile application, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Services Description

MDS provides intra-city and inter-state parcel courier services within Nigeria. Service availability, pricing, and delivery timeframes are subject to change and may vary by location and service type.

3. Account Registration

  • You must be at least 18 years old to create an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must provide accurate and current information during registration
  • MDS reserves the right to suspend or terminate accounts that violate these terms

4. Booking and Payment

  • All bookings must be paid for before pickup unless otherwise agreed in writing
  • Prices are as quoted at the time of booking and are subject to change without notice for new bookings
  • Payment must be made via approved payment methods (Paystack, Flutterwave, POS, or approved credit accounts)
  • MDS reserves the right to cancel bookings where payment cannot be processed

5. Prohibited Items

The following items are strictly prohibited:

  • Firearms, ammunition, or weapons of any kind
  • Illegal drugs, narcotics, or controlled substances
  • Live animals or animal products restricted by law
  • Hazardous, flammable, explosive, or radioactive materials
  • Currency, financial instruments, or precious metals exceeding ₦100,000 without declaration
  • Any item prohibited by Nigerian federal or state law

MDS reserves the right to inspect and refuse any shipment suspected of containing prohibited items. Customers may be held liable for any costs, fines, or penalties arising from prohibited items.

6. Liability and Insurance

  • MDS liability for loss or damage is limited to the declared value of the parcel, up to the maximum insured amount for the selected service tier
  • MDS is not liable for indirect, consequential, or business losses
  • Claims for loss or damage must be filed within 48 hours of the delivery attempt or scheduled delivery date
  • MDS is not liable for delays caused by force majeure, including weather events, civil unrest, or government actions

7. Delivery Attempts

MDS will make two delivery attempts. After two failed attempts, the parcel will be held at the nearest branch for up to 5 business days. After this period, the parcel may be returned to sender at the customer's expense, or disposed of if unclaimed after 30 days.

8. Driver Code of Conduct

Drivers using the MDS platform must comply with Nigerian traffic laws, maintain professional conduct, and handle all parcels with care. MDS reserves the right to deactivate driver accounts for violations of the Driver Code of Conduct.

9. Intellectual Property

All content on the MDS website and application, including logos, text, images, and software, is the property of MDS and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

10. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the Nigerian courts.

11. Changes to Terms

MDS may update these Terms at any time. Continued use of our services after notification of changes constitutes acceptance of the updated Terms.
